Welcome to Costimator, a platform developed and owned by Create2Inspire Private Limited (“Company”, “we”, “us”, “our”). These Terms and Conditions (“Terms”) govern your access to and use of the Costimator web and mobile application, including all related tools, content, and services (collectively, the “Service”).

By using Costimator, you agree to be bound by these Terms. If you do not agree, please do not access or use the Service.

1. Eligibility

You must be at least 18 years of age to use this Service. By using Costimator, you confirm that:

• You are legally competent to enter into a binding agreement;

• All information you provide is accurate and up-to-date;

• You are using the Service in compliance with all applicable laws and regulations.

2. Account Registration and Security

Access to Costimator requires registration. You agree to:

• Keep your login credentials secure and confidential;

• Be fully responsible for all activities that occur under your account;

• Notify us immediately at support@costimator.in in case of any unauthorized access or security breach.

We are not liable for any loss or damage resulting from your failure to comply with these obligations.

3. Services and Access

Costimator offers features including but not limited to:

• Smart search across DSR & DAR 2023 rates;

• Estimation tools with live rate analysis;

• Custom rate inputs;

• Always-online access via secure login;

• Project management tools and dashboards.

We may modify, suspend, or discontinue any part of the Service at any time without notice.

4. Payments, Subscriptions, and Refunds

Access to certain features of Costimator (“Pro Plan”) requires an annual subscription.

• All payments are processed securely through third-party payment gateway Razorpay.

• All sales are final. No refunds will be issued for any subscription once purchased.

• Renewal is automatic unless you cancel before the billing date.

It is your responsibility to ensure payment methods are valid and current.

5. Third-Party Services

Costimator integrates with third-party services such as:

• Supabase (data storage & user authentication)

• Resend.com (transactional emails)

• Razorpay (payments)

• Various content delivery networks and image providers

We do not control these services and are not responsible for their availability, performance, or security practices. Your use of third-party services is subject to their respective terms.

6. User Content and Custom Inputs

The Service allows you to input or upload your own content, such as:

• Custom rates

• Project data

• Notes or calculations

You retain ownership of your content, but by uploading or submitting it, you grant us a license to store, process, and display it for your use within the app. You are solely responsible for the accuracy and legality of your content.

7. Data Privacy and Security

We collect and store personal data such as:

• Email addresses

• Project-specific content

All data is stored securely using Supabase’s managed infrastructure. While we implement industry-standard protections, we cannot guarantee absolute security and are not liable for unauthorized access beyond our control.

8. Intellectual Property

All rights, title, and interest in:

• The Costimator brand

• The software, tools, content, structure, and visual assets belong to Create2Inspire Private Limited.

You may not reproduce, distribute, reverse-engineer, modify, or create derivative works of the Service without prior written consent.

9. Prohibited Use

You agree not to:

• Use the Service for any unlawful or unauthorized purpose;

• Attempt to gain unauthorized access to systems;

• Introduce viruses or malicious code;

• Interfere with other users’ experience;

• Resell or sublicense the platform.

Violation of these terms may result in immediate termination of access.

10. Disclaimers

Costimator is provided “as is” and “as available” without warranties of any kind. We do not guarantee:

• That the Service will be error-free or uninterrupted;

• That calculations or outputs will be accurate for every scenario;

• Suitability for any specific construction project or regulatory compliance.

You use the Service at your own discretion and risk.

11. Limitation of Liability

To the fullest extent permitted by law, Create2Inspire Private Limited shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, profits, or business opportunities, arising from your use or inability to use the Service.

12. Indemnification

You agree to indemnify and hold harmless Create2Inspire Private Limited, its directors, employees, and agents, from any claims, liabilities, damages, or expenses arising out of:

• Your use of the Service;

• Violation of these Terms;

• Infringement of any rights of a third party.

13. Termination

We reserve the right to suspend or terminate your access to the Service at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users or the Company.

14. Governing Law and Jurisdiction

These Terms are governed by the laws of India.
